New York Federal Court Approves Settlement in Zinc Market Manipulation Antitrust Case

On February 16, 2022, U.S. District Judge Paul A. Engelmeyer of the Southern District of New York approved the parties’ settlement in In Re Zinc Antitrust Litigation, Case No. 14 Civ.3728 (PAE) (S.D.N.Y), an antitrust class action filed in 2014 against Defendants Glencore Ltd. and Access World (USA) LLC (f/k/a Pacorini Metals USA, LLC) alleging, inter alia, monopolization and attempted monopolization conduct resulting in inflated market pricing for Special High Grade Zinc (“SHG Zinc”). The $9.85 million recovery is the result of protracted litigation that included the filing of consolidated and amended complaints, extensive discovery spanning several years, and extensive, arms’ length settlement negotiations.

The settlement provides cash payments to class members who purchased SHG Zinc between September 14, 2010 and February 11, 2016, and who file valid and timely claim forms in connection with those purchases.
